Researchers who reported that a potentially ancient Buddha statue is carved from a meteorite said they are not surprised that an expert in Buddhist history believes the statue to be a fake.

"Honestly, that is what we expected," said Elmar Buchner, who along with his colleague?reported on the statue in September?in the journal Meteoritics & Planetary Science. "We heard so many opinions from so many experts in art history and experts for Buddhism on the origins and the age of the statue prior to and after the publication."

The most public of these consultations is a new report from Achim Bayer, a Buddhism expert at Dongguk University in South Korea. In a report released online, Bayer writes that the features of the statue are "pseudo-Tibetan" and are?more likely to be a European reproduction?dating from 1910 to 1970 than a true ancient carving dating back 1,000 years, as Buchner and his colleagues had estimated.

Bayer did not contest that the statue is a made of meteorite

"The non-Asian features of the 'lama wearing trousers' should be immediately obvious to any scholar in the field," Bayer wrote, referring to the statue as a "lama" or guru. The shoes, pants and sleeves of the man's garments are all wrong for ancient Tibet, he wrote. The statue's hands, eyes and ears are also shaped unusually for Tibetan art, he said.

The statue was said to have come to Germany in the possession of a pre-World War II scientific expedition commissioned by the?Nazi party. Bayer called that into question, too, saying there is no documentation of the statue's transfer and arguing that it is more likely a fake created in the 20th century for the antique or Nazi-memorabilia market.

"For us, Bayer's hypothesis is just one opinion," Buchner wrote in an email to LiveScience. "However, we cannot decide whether this hypothesis is valid or not because we are not the experts in art history, and we told the press that our assumptions are speculative, accordingly," wrote Buchner, who is a geologist.

The geochemical analysis of the meteorite is still sound, Buchner said. The team found that the material used to make the statue is a rare type of iron- and nickel-rich meteorite from a meteorite fall along the Siberian-Tibetan border. [Top 5 Weirdest Meteorites]

That cosmic origin brings up one more mystery in the tale of the controversial space Buddha.

"I think it is not convincing that anybody took a very precious meteorite to produce a reproduction for the local antique market!?" Buchner wrote.

10 Tips to Help You Navigate the Estate Planning Process ...

Attorney John O'Grady offers these tips for getting -- and keeping -- your affairs in order.

How will protect the legacy of your estate?

Estate Planning Lawyer John O?Grady recently offered some sound advice to SevenPonds readers for launching the tough conversation about end-of-life and getting started with creating a Will through his interview for our Professional Advice segment. We know this is a tricky topic, so we asked John if he could share just a little more. He?s flush with information, and we?re so grateful for his generosity in sharing it for all of you!

These ten estate planning tips were originally published by John O?Grady, and they?re published here in full with his permission.

1. Talk it Over. The road to solid estate planning is paved with communication. Get your trusted loved ones and advisors involved. The fewer surprises to your survivors after your death, the less chance there will be confusion or disputes. An estate plan is a great idea regardless of your net worth.

2. Work with Your Estate Lawyer. Cultivate a long-term dialogue with your estate planning lawyer long before you are in a hurry to get something done. Often you get what you pay for. Bear in mind that a poorly done (?inexpensive?) estate plan can result in unnecessary headache and expense down the road.

3. Take Your Time and Be Relentless. Take time to consider all of your options. Ask questions of your lawyer and your loved ones and be sure that they are answered to your satisfaction.

4. Update Beneficiary Designations. Name beneficiaries for retirement plans such as IRAs, life insurance policies and some types of jointly-held accounts. These designations preempt anything specified in your Will. Contact your financial institutions to review yours.

5. Choose Successors Wisely. Designate individuals that you trust the most to act on your behalf, not merely the oldest child or the closest relative. Your designee should be competent, trustworthy, willing to take on the burden of your affairs and financially secure. Consider a professional or corporate trustee if you do not feel comfortable with anyone else.

6. Remember that it is Only a Plan. You will learn much by living with your plan for a while. Plans are made to be changed. Review all of your estate planning documents and beneficiary designations every 3-5 years and after any major life event (e.g. marriage/divorce, death, birth, significant change in financial situation, move, or change in property ownership). You may amend your estate plans during your lifetime.

7. Pay Attention. Make sure names are spelled correctly in all estate plan documents. Your documents should clearly specify who will inherit your property if those you name predecease you.

8. Consider Your Digital Assets. A list of all computer accounts and passwords for your successor trustee can protect your assets and eliminate needless detective work and stress for your grieving loved ones upon your death or disability. Consider everything stored on a computer or in the cloud, including bank, credit card or investment accounts; insurance policies, intellectual property and personal files.

9. Leave a Trail. Make sure that each and every person who needs to find your paperwork after your death knows where to look. Establish at least two secure places (one in another state, if possible), and ensure there is a complete and up-to-date set of documents in both places at all times. make it easy for them to locate your bank accounts, passwords, life insurance policies, funeral arrangements, etc.

10. Celebrate When You Update Your Estate Plan! Signing your estate planning documents is a big step. Enjoy being someone who lives fully by facing the difficult questions of life, incapacity, and death while powerfully providing for yourself and your loved ones!

Shares for rights is a Westminster, not real world, plan

In his speech to the Conservative Party conference earlier this month, the Chancellor unveiled a ?100million ?employee-owner? scheme that will allow shares worth ?2,000 to ?50,000 to be exempt from tax if employees give up certain work rights, such as the right to claim unfair dismissal.

George Osborne said the measure was aimed at the tens of thousands of small and medium-sized firms and would allow businesses hiring staff to insist they forfeit employment rights in two broad areas in exchange for the shares, which would be exempt from capital-gains tax. Existing employees would have the right to refuse.

There has been some support for the proposal, including from the Director General of the IoD, but my view is that the scheme lacks cohesion. It is early days and little detail has been released so far, perhaps my concerns will be allayed, but for what they are worth, here they are.

Under the policy, employees would:

  • Give up their rights under UK law on unfair dismissal, redundancy and the right to request flexible working and time off for training;
  • Women would have to give twice as much notice of the date when they want to return from maternity leave. Women currently have to give eight weeks, but this would increase to 16.

This is likely to have a disproportionate effect on women. So at a time that many firms are adopting flexible working practices to enable working parents to juggle the complexities of modern life, this scheme may well limit parents? ability to work and care for their children. At the heart of this point lies the question that if businesses are moving towards more flexible working practices why do we need legislation to prevent what appears to be a popular practice?

John Timpson of shoe repair fame, says the policy is based on a misconception ?that employee shares are a magic wand?.

?It is, quite rightly, fashionable to admire the John Lewis Partnership, but their success isn?t just due to the share structure,? he says. ?Share ownership doesn?t in itself create a more committed workforce. In many small businesses, like ours, it is much better to award a significant bonus based on profits than create the complications that come with issuing equity.?

In my view the main stumbling block in the policy is the question of equity, and what it will actually mean to the employee. How many employees will have the experience to quantify their equity and the potential upsides and downsides? How easy will this be to assess particularly if they are desperate to work?

And assuming that the value of shares and apportionment can be agreed (good luck with a start-up) what happens when the employee wants to sell their shares? Has Mr Osborne ever tried to sell a minority interest in a privately held business? The policy appears to be predicated on the shares being liquid, as they are in a listed business, but this is not the case. What investor would want to purchase ?2,000 worth of shares in a privately owned business?

The policy aims to cut regulation to enable business owners to focus on trading but what happens when employers and employees get into disputes regarding the shares? value or the employees? ability to sell the shares? What happens on an employee leaving? There will be significant amounts of time and money spent on lawyers? bills, corporate finance fees and the like.

As someone who works in the corporate finance industry I would be quite happy to charge for valuations and negotiation services but to be frank, what a waste of time. The fees and management cost are going to rival / outweigh the current cost of employment disputes.

The idea of the scheme is to free up business owners to make investment decisions. But for most businesses ? and particularly services businesses ? employees are the biggest investment. How are you going to attract top talent if you cannot give them basic employment assurances?

Many employees are just that for a reason. They are not entrepreneurs. They do not want the risks associated with being an entrepreneur and favour the relative security of employment. This policy is aimed at the SME market and especially start-ups. But bear in mind that approximately one in three start-ups fail in their first three years. So any employee taking on the shares could well be left with a handful of nothing.

It could be that these questions are answered in due course when further detail is released, but for the moment it appears that the plan has been devised by people who have spent their careers in Westminster, not in the boardroom and certainly not on the shop floor.

KANSAS CITY, Kan. (AP) - All that Sporting Kansas City needed Wednesday night was a draw against the Philadelphia Union to wrap up its second consecutive Eastern Conference regular-season title.

C.J. Sapong sent the club into the MLS playoffs with a win.

His goal off an assist from Kei Kamara in the 82nd minute ultimately gave Sporting KC a 2-1 victory Wednesday night, pushing the club's unbeaten streak to 12 games and giving it a massive wave of momentum as it chases its first MLS Cup title since 2000.

"It's a totally new season coming up," Sapong said.

Antoine Hoppenot scored an equalizer early in the second half for the Union (10-17-6), but Sapong answered when Kamara found him open on the wing late in the game. Sapong's shot past Union goalkeeper Zac MacMath found the back of the net for his ninth goal of the year.

"We knew it would be a very difficult match today. There wasn't much for them to lose," Sporting KC coach Peter Vermes said. "The important thing is that we came out to play."

Jacob Peterson had the other goal after entering the game as a first-half injury substitute for Sporting KC (18-7-9). Its franchise-record point total of 63 is six clear of second-place D.C. United, which has one game remaining in the regular season this weekend.

Sporting KC opens the two-leg conference semifinals on the road Nov. 3 or 4 against an opponent yet to be determined. The return match is Nov. 7 at Livestrong Sporting Park.

"We know a whole new season starts," Vermes said, "and it's a clean slate, and it's not going to be easy. I think right now we're ready for it."

Peterson came on as a substitute when Paulo Nagamura had to limp off with a sprained left ankle in the 33rd minute. He got his chance to make an impact in the 40th, when Sapong swung a pass to Kamara on the wing, and he pushed the ball ahead to Peterson the breakaway.

Peterson out-ran the Union's Carlos Valdes to reach it first, and then ripped a shot just past the outstretched hands of MacMath to give Sporting KC a 1-0 lead.

It was Peterson's career-high fourth goal of the year.

Sporting KC had a chance to add to its lead in the final minute of first-half stoppage time when Sapong set up Graham Zusi in front of the net. The U.S. national team member sent a shot at MacMath that he saved in self-defense, and then another on the rebound that he also saved.

The Union attacked early in the second half, and Matt Besler was called for a foul on Danny Cruz in the penalty area. Michael Farfan took the shot and Jimmy Nielsen made a sprawling save to his left before Hoppenot - a second-half substitute - drove home the rebound for the tying goal.

Hoppenot's fourth of the year was only the 27th that Sporting KC allowed in 34 games this season, but it proved to be a costly one for Nielsen. The goalkeeper was less than a half away from matching Tony Meola's MLS and club record with 16 shutouts set during the 2000 season.

"He'll tell you that the number-one thing is htat we won," Sporting KC defender Matt Besler said. "We'll all replay that one in our minds a little bit, but it's not the important thing."

The important thing is that Sporting KC is the top seed in the Eastern Conference.

The club will begin pursuit of another title in a couple weeks, grateful it won't have to worry about pesky Philadelphia. The Union pounded Sporting KC 4-0 on June 23, the only time outside an exhibition game against Montpellier-Herault SC that an opponent scored two or more goals.

Sporting KC rebounded to beat Philadelphia 2-0 in the U.S. Open Cup semifinals.

"We expect to be here," Besler said. "It's a feeling we expect. It's a big accomplishment to be here two years in a row, but we want more than this."

Europe shapes Moon lander design

European industry has outlined the basic design for a robotic probe that could be dispatched to the Moon's south pole in 2018.

The 800kg craft would demonstrate fully automated landing technologies and place some environmental experiments on the surface, including a mini-rover.

The mission proposal will be discussed by national space ministers when they meet in Naples, Italy, next month.

They will be asked to approve further development costed at about 100m euros.

Full implementation ? the construction of the lander, its launch and surface operation for six months - would probably total 500m euros (?400m), but any final approval would not be given before 2014.

The Moon lander is a project of the European Space Agency (Esa), and is being run out of its human spaceflight directorate. Its science is therefore geared towards the needs of future astronauts.

Experiments would probe the soil for signs of resources that could be exploited by humans on the satellite?s surface. Instruments would also assess the environmental challenges of operating on the body, such as the dangers posed by radiation and lunar dust.

An industrial consortium, led by the German division of Astrium, Europe?s largest space company, was asked to scope out the basic concept for the robotic mission. This so-called Phase B1 study listed the technology requirements, and initiated some early development work and testing.

It also priced the full project ? a key piece of information for ministers when they deliberate the next phase at their Council gathering on 20-21 November.

The Phase B1 work concentrated on the major technologies needed for landing.

Engineers want the vehicle to scan ahead for possible hazards (boulders, craters, steep slopes, etc) in the final 90 seconds of the descent, and be able to take evasive action if a dangerous obstacle looms into view.

The required visual navigation technologies are currently under development at the German space agency?s Institute for Space Systems, in its Tron (Testbed for Robotic Optical Navigation) facility, in Bremen. Likewise, landing leg design is being investigated in the institute?s Lama (Landing and Mobility Test Facility) laboratory.

Work on the propulsion system that will take the probe down to the surface has been conducted at Astrium?s Lampoldshausen centre. The robot lander will have an array of pulsed thrusters on its underside.

"To be able to go down on the thrust of the engines, to recognise the terrain during the descent and make lateral moves if required to make a soft and precise landing is, for sure, something we need at the Moon. But these are also technologies we would like to use at other planets,? said Dr Michael Menking, senior vice president for orbital systems and space exploration at Astrium.

"One of the most ambitious activities for the future is sample return ? to bring rocks back to Earth. This is discussed in terms of Mars but also the south pole of the Moon; and you can see the activities that we are pursuing here feed into those future programmes.?

The spacecraft would be targeted at the lunar south pole because it has locations that enjoy extended sunlight. This is necessary because Europe does not possess the radioisotope space technology capable of generating the power and heat needed by robots to survive long periods of darkness.

One possible landing site already under discussion is a plateau known as Leibnitz-beta, which is just north of Shackleton Crater.

There, the Sun stays above the horizon for months on end, explained Dr Peter Kyr, Astrium's head of robotic exploration and space robotics.

"At the south pole, theoretically, you have some 'eternal sunlight'. But, OK, you have a topographic horizon so you also have shaded areas and we are not allowed to stay too long in a not-illuminated area.

"We have the capability to stay in darkness for two days, but then we need sunlight to recharge our batteries.

"Hazards for us are rocks, craters and slopes ? but also shadows," he told BBC News.

The Moon lander will be just one item on a long list of projects up for consideration at the ministerial meeting.

Of Esa?s 19 member states, Germany has so far been its main proponent (funding 70% of the B1 phase), with lesser participation coming from the likes of Portugal, Spain, Canada and the Czech Republic.

France, Italy and the UK ? three major funders of Esa activity ? have yet to put their weight behind the concept.

Their interest and participation could be a decisive factor in how far and how fast the lander project progresses.

Given the pressures on the European economy currently, ministers are inevitably facing some tough choices as they try to set Esa?s priorities for the next few years.

Less Biodiversity Decreases Climate Change Resilience

A new study has found that the impact of climate change is likely to be worse if species are lost. High biodiversity increases the likelihood that some species will be sufficiently resilient to a changing environment.

In order to discover how biodiversity affects climate change resilience, biologists at the University of Gothenburg in Sweden experimented with eelgrass meadows in shallow inlets on the west coast of Sweden reveal that climate change can exacerbate the negative effects of losing sensitive species, and that the insurance effect of biodiversity may be weaker than what we typically assume.

This is thought to be due, in part, to eutrophication - the response of an ecosystem to the addition of artificial or natural substances. When eutrophication occurs it favors mats of filamentous 'nuisance' algae which shade and suffocate the eelgrass. The loss of cod in the area, in part has also resulted in a huge increase in numbers of smaller predatory fish.

At the Sven Lov?n Centre for Marine Sciences' Kristineberg Marine Research Station on Gullmarsfjorden, researchers from the University of Gothenburg's Department of Biology and Environmental Sciences have developed miniature ecosystems in outdoor aquariums and have been investigating how future ocean warming and ocean acidification could affect the balance between eelgrass and filamentous algae. The effects were unexpectedly clear and unambiguous: it was the diversity of algal herbivores that determined the extent to which the ecosystem was affected by warming and acidification.

The researchers believe that we should be concerned about the results. "Most management is based on the assumption that we [can] afford to lose the most sensitive species because other, more resilient species will take their place," says researcher and biologist Johan Ekl?f. "But this may not be the case with future climate changes, as it can reduce the net efficiency of the resilient species - without directly affecting them."

However, the researchers are also careful to point out that there is still hope if society does decide to take action. "If we protect the local biodiversity we still have, and restore the diversity we've lost, by for example protecting predatory fish stocks in coastal areas and reducing nutrient loading, then we'll probably be able to increase the ecosystems' resilience to climate change."

DuPont to slash 1,500 jobs to counter falling sales

DuPont reported a lower-than-expected quarterly profit on Tuesday and announced 1,500 job cuts as part of a cost savings program designed to offset falling sales around the world.

The move by DuPont, a member of the Dow Jones industrial average?and the maker of Kevlar bulletproof fiber and Corian countertops, marks one of the more extreme reactions to slipping demand and global economic uncertainty so far in this earnings season.

DuPont's sales fell 9 percent to $7.4 billion in the third quarter, while analysts on average had expected $8.15 billion. Demand fell most sharply in Asia and Europe, hurt by higher prices for titanium dioxide paint pigment and solar panel parts.

The company posted net income of $10 million, or a penny per share, compared with $452 million, or 48 cents per share, a year earlier.

Excluding one-time items, DuPont earned 44 cents per share. By that measure, analysts on average expected 46 cents, according to Thomson Reuters I/B/E/S.

The company plans to lay off 1,500 workers around the world - about 2 percent of its 70,000-person workforce - in the next 12 to 18 months as part of a restructuring plan it hopes will save about $450 million.

DuPont expects to earn $3.25 to $3.30 per share this year, below the $3.93 that Wall Street has forecast.

Long Term Real Estate Investment Success Doesn't Come From A ...

When you read something here or elsewhere that you?ve not known of before, in what way do you process it? Do you review how the new info might?ve helped you years ago? Or maybe it would?ve easily helped you avoid a mistake you made years ago ? one that put you on a financial treadmill to nowhere ?til ya caught up. Thing is, the information age is a lethal double-edged sword. View it as a good news/bad news joke.

The good news is that you have all that info and those bazillion data points at your fingertips. The bad news? See the good news.

As the title to this post proclaims, success doesn?t come from set recipes. We?re not baking cookies from a prepackaged batch of cookie dough, when all that?s required is to slappin? the dough down onto the bakin? pan, and turnin? the oven on, per printed instructions. Investing requires different ingredients for different investors, even though their most important goal ? retirement ? may be the same as millions of others. What passes for real analysis, not to mention strategy(s) is often nothin? more than over simplified formulas applied to broadly described circumstances, which are then recognized by thousands of people who think the various strategies/recipes/formulas apply to them. Again, we?re not bakin? cookies here. We?re investing to create the most important thing there is as we grow older ? after health ?n family ? retirement income.

What happens is that a particular strategy is put forth as superior. Any strategy, when assessed in a vacuum, can deliver damaging results when applied in the rough ?n tumble of real life. Even if any particular strategy delivers positive results, so what? Could they have been better if using a competing approach? Are there distasteful long term consequences for which you?re currently unaware? How would you know?

And there?s the rub.

The decisions you as an investor?made yesterday,?make today, and will make five years from now ? on what strategy(s) to employ ? will literally make the difference in the quality and quantity of your income at retirement. But again, the real fly in the ointment is the reality that what worked in San Diego in 2000, would be a wish for a financial coma today. What proves wildly effective for Fred, would be foolish for Abby, even though on the surface they appear to be two peas in a financial pod. In fact, what made sense five years ago, might be the last thing to do now. There are too many crucially important factors involved in the decision making process as it relates to investment strategy to approach it as merely the catalyst to a simple recipe.

It?s almost never about the ?best? strategy.

Earlier this month my ?CEO? and his wife were in town for my benefit. The Boss and I took ?em out to dinner to say thanks. The chef at this place is well known not only for how fantastic her meals taste, but also for the many awards she?s won for excellence. From the appetizer to the main course, who knows how many cooking ?strategies? she brought into play, many in a wonderfully synergistic fashion. I won?t bore you with all the details ? OK maybe a quick summary. :) Duck nachos isn?t on the menu as it once was, but if you ask for them, they?ll make it. Awesome. Then there was the porterhouse pork steak with a sinfully good reduction sauce. How many different strategies must it have taken to produce those nachos alone? Was the steak prepared using the same strategy(s) utilized in making the sauce?

The TakeAway

Regardless of what you?ve read and heard, a single strategy ain?t gonna produce the retirement you want. Even those makin? use of more than one strategy will generally fall short. What produces magnificently abundant retirements is Strategic Synergism ? the blending of multiple strategies, often completely unrelated to each other, in ways that ultimately enhance your final results. When an investor realizes the hugely superior results obtained when combining multiple strategies synergistically, a whole new menu of possibilities opens up. Everyone agrees that cash flow at retirement is the goal. It?s how you get there, and how much after tax cash flow your specific Plan generates.

Sadly, the vast majority of Americans are creating what I?ve come to call a ?FastFood? retirement. Fast food is fun every now and then, but we all know what happens long term if you live on it. Strategic Synergism works in the kitchen, and it works when investing for retirement.

Alien hunting: Don't rule out finding DNA on Mars

No one has looked for life on Mars for more than 30 years, ever since NASA's Viking missions sent back inconclusive results. Genomics maverick Craig Venter wants to change that. Cracker of the human genome and builder of synthetic life, Venter announced at the Wired Health Conference in New York last week that he wants to send a DNA sequencer to Mars and beam back the genomes of any alien microbes.

Details of this ambitious plan are slim, and Venter has declined to elaborate. But there is reason to think Mars DNA can be found ? if we know how and where to look.

Previous hunts for life, including the experiments on the Viking landers, looked for organic molecules on Mars's surface. The results have been plagued by ambiguity, especially in the light of growing evidence that organic molecules can be formed by natural processes that do not involve life.

Finding DNA would be a much more direct indicator of life, and there is a chance it is out there. The precursors to ribose ? the sugar found in DNA and RNA ? have been detected in interstellar space, and complex organic molecules have been found on Saturn's moons Titan and Enceladus. Life's raw materials could have spread throughout the early solar system, and life may have emerged several times from a common set of ingredients.

Alternative chemistry

It's also possible that life hitched a ride between Earth and Mars in their early days. Asteroid impacts have sent about a billion tonnes of rock careering between the two planets, potentially carrying DNA or its building blocks. That could mean that any genetic material on Mars is similar enough to DNA that we have a chance of finding it using standard tests.

Even if we don't, we can set up future sequencers to look for molecules that use alternative sugars or chemical letters in the genetic code. "We're not there yet, but it's not a fundamental limitation," says Chris Carr of the Massachusetts Institute of Technology, who works on the NASA-backed Search for Extraterrestrial Genomes.

Another option is for a DNA sequencer to piggyback on an organics-hunting suite. Searching only for DNA as we know it means we might miss alternate life-forms, says Michael Meyer, lead scientist for NASA's Mars Exploration Programme. A sequencer could follow up on an organics find by looking for DNA and testing whether any found has earthly origins.

Secret tunnels

Since Viking, though, NASA has mostly played it safe, scouring Mars's surface not for the chemical signatures of life but for ancient habitable environments ? the goal of the Curiosity rover. NASA has gone this route because Mars lacks a thick atmosphere and protective magnetic field, so it is exposed to damaging ultraviolet light and cosmic rays. Any life would have to be shielded under at least a metre of soil or rock to survive. What's more, recent work has shown that DNA breaks down at a predictable rate. That rules out any genetic traces more than a million years old surviving.

Venter's plan would need to target more fertile hunting grounds deeper inside Mars. Luckily, the technology to do that may already exist. The European Space Agency's ExoMars mission, slated to launch in 2018, will have a drill that will delve at least a metre deep. Robot explorers might also aim for lava tubes, tunnels excavated by ancient volcanic flows and shielded from radiation. NASA's Jet Propulsion Laboratory is already developing a rover called Axel that can abseil down cliffs and could head into a Martian cave.

If a DNA sequencer is flight-ready when the next Mars rover launches, would NASA consider adding it in? "Of course," Meyer says. "It certainly is a worthy cause."

Cesar Vargas, Undocumented Immigrant, Applies To Practice Law ...

Cesar Vargas filed an application to practice law Monday in New York, forcing the state to become at least the third to consider allowing undocumented immigrants into the legal profession.

As a potential beneficiary of the new federal policy allowing people brought illegally to the United States as children to apply for work authorization, Vargas has reason to hope.

"We're not asking for special benefits," Vargas told The Huffington Post. "I want them to look at my character and who I am, not my immigration status."

Brought to New York from Puebla, Mexico, at the age of 5, Vargas dreams of joining the military to serve in the Judge Advocate General's Corps. (Watch Vargas discuss his military dream in a 2010 press conference below.)

But upon graduating from City University of New York and passing the bar exam last year, he didn't immediately apply to practice law in the state. Instead, Vargas, who has pushed for the federal Dream Act, helped launch the consulting and advocacy firm DRM Capitol Group, which lobbies to pass the federal legislation and supports similar state-level initiatives.

Vargas said the Obama administration's decision this year to defer deportation for people who, like him, were brought to the United States illegally as children made him more optimistic about his chances of becoming a lawyer. The new federal policy allows those under age 31 who arrived in this country before age 16 to apply for work authorization. Vargas, 29, applied for deferred action two weeks ago and has a fingerprint appointment scheduled.

"What's the point of licensing someone if they can't even work?" Vargas said. "With deferred action, we're more hopeful."

He also comes armed with glowing letters of support from people in high places.

"I thought so much of his work ethic that I asked Cesar to be my teaching assistant for my Criminal Law class during his second year at CUNY Law," wrote Michelle Anderson, the dean of the law school. "It is worth noting that there is no prohibition in New York law against a specific category of persons becoming members of the Bar. The Appellate Division should not develop such an unprecedented exclusion."

Another letter, signed by members of Congress including Reps. Nydia Velazquez (D-N.Y.) and Raul Grijalva (D-Ariz.), takes a more general approach:

To deny undocumented students the opportunity to become doctors or lawyers or to practice another profession is to deny the State of New York and our nation the benefits of an educated, talented and tax-paying workforce.

Undocumented immigrants in at least two other states have applied to practice law.

Jose Godinez-Samperio's case is pending before the Florida Supreme Court. The justices appeared to view his request for admission to the bar with skepticism at a hearing earlier this month, according to the Associated Press, but were considering delaying their decision to see if Godinez-Samperio, 25, secured work authorization under the federal deferred action policy. Godinez-Samperio had filed his bar application before President Barack Obama announced the new policy.

The California Supreme Court is looking at a similar case in Sergio Garcia's request for admission to the bar. Although the state bar association has recommended allowing him to practice law, the court is weighing whether his license would conflict with federal laws that prohibit knowingly contracting with undocumented workers and that bar states from providing "public benefits" to undocumented immigrants. At 35, Garcia is too old to qualify for deferred deportation, but could work as an independent contractor, the California State Bar said in a court filing.

Before meningitis outbreak, firm avoided sanctions

BOSTON (Reuters) - The pharmacy tied to a deadly U.S. meningitis outbreak escaped harsh punishment from health regulators several times in the years leading up to a deadly U.S. meningitis outbreak that has raised questions about oversight of the customized drug mixing industry, newly released state records show.

Problems at the New England Compounding Center (NECC) in Framingham, Massachusetts, date as far back as 1999, the year after it began operations, according to hundreds of pages of documents obtained under a Freedom of Information Act request.

And the documents show regulators refraining from the harshest sanctions available to them, even as the list of complaints against NECC continued to grow.

The documents come to light after 23 people have died and close to 300 have become ill with fungal meningitis linked to steroid shots from NECC given to thousands of patients across the country. And a top medical expert says the outbreak is not over and there will be more cases in the coming weeks.

Among the reported problems was a company official handing out blank prescriptions. And an outside evaluation firm found inadequate documentation and inadequate process controls involving sterilization at NECC in 2006, the documents show.

"Although your facility has seen significant upgrades in facility design for the sterile compounding operation, there were numerous significant gaps identified during the assessment," according to a 2006 letter to NECC from Pharmacy Support Inc, an outside evaluation firm.

Summing up the violations and concerns, one state inspector in 2004 recommended the company be given a formal reprimand, a sanction that would be made public and potentially hurt business.

The complaints hinted at bigger problems emerging at NECC as it grew from a tiny family business owned by chief pharmacist Barry Cadden and his brother-in-law, Gregory Conigliaro, into a drug compounding juggernaut selling products in bulk to hospitals and clinics in nearly 50 states.

"New England Compounding Center worked cooperatively with the Massachusetts Board of Registration in Pharmacy to resolve to the Board's satisfaction any issues brought to the company's attention," NECC said in a statement on Monday.

NECC's improvements drew praise from George Cayer, president of the pharmacy board at the time.

"The board commends NECC on the progress to date," Cayer said in an April 12, 2006 letter. Cayer is currently a member of the pharmacy board.

HISTORY OF COMPLAINTS

The pharmacy board initially proposed sanctioning NECC in 2004 with three years of probation and a public reprimand amid allegations that the pharmacy violated accepted standards for compounding methylprednisolone acetate, the same steroid that is linked to the current fungal meningitis outbreak.

But two years later, the board agreed to a nondisciplinary settlement. It also agreed not to report the agreement to the National Association of State Boards of Pharmacy or other outside agencies. NECC's lawyer had pleaded with the board not to issue a public reprimand because it could put the company out of business.

In 2004, pharmacists in Iowa and Wisconsin complained to the board that NECC and its chief pharmacist, Barry Cadden, were soliciting out-of-state prescriptions for office use and using a form unapproved by the Massachusetts Department of Public Health.

That same year, the board issued another advisory letter to NECC noting that it had received a complaint from a "concerned Texas pharmacist about products being solicited by Barry Cadden." An investigation revealed that NECC was offering an eye treatment and improperly included promotional material and terminology in the advertisements.

Pharmacies such as NECC are typically allowed only to compound drugs based on a specific prescription written by a physician for an individual patient. They are not generally allowed to solicit business or to promote products that have not been requested by physicians.

Don?t assume group brainstorming works. More often than not it doesn?t.

Imagine you?re leading a brainstorming session at your company. You want to come up with growth strategies, so you gather your team in a meeting room, generate lots of ideas, and choose the most promising one. Like many SME owners, you think this is the best move. Unfortunately, it often doesn?t work. In fact, it makes your team less creative.

Here?s the real truth: group problem solving can be extremely effective, but only if it?s done right ? and the usual method is disastrous.

Generating ideas together doesn?t work because group members influence each other?s suggestions.

Your brain solves a problem by retrieving relevant memories that might lead to a novel solution. When someone else suggests an idea, your mind limits itself to related memories, eliminating ideas you might have considered and impeding the creative process.

An effective group brainstorm circumvents that trap. It includes a four-step process that promotes creativity and independent thought.

1. Think independently. First, ask each person to generate their own ideas before the group comes together. Individuals working alone will explore a broader range of ideas, and they?ll each have a fair shot at bringing their best work to the table.

2. Share all ideas. Next, ask each person to submit their best ideas. Compile them in one document then send them to the group. This way, everyone is exposed to a wide range of ideas, including suggestions that might have been overlooked in a meeting.

3. Review separately. Before you meet in a group, ask each person to take notes on the other ideas. Have them look for the potential advantages of each idea or solutions to potential problems. Early on, you don?t want people criticising too much though, because this closes off every idea that looks new.

4. Discuss together. Finally, it?s time to bring the group in for the brainstorm. Ask each person to suggest ideas that seem the most promising, then debate the pros and cons. Because each person reviewed the ideas independently, you?ll have a more fruitful discussion.

If one person thinks they see a flaw in the idea, then someone else can be an advocate for it. You may be able to get around an issue even if it?s a valuable criticism.

Specific bacterial species may initiate, maintain Crohn?s

ScienceDaily (Oct. 22, 2012) ? Patients newly diagnosed with pediatric Crohn's disease had significantly different levels of certain types of bacteria in their intestinal tracts than age-matched controls, according to a paper in the October Journal of Clinical Microbiology. The work may ultimately lead to treatment involving manipulation of the intestinal bacteria.

The research grew out of many years' study of gastrointestinal diseases, a particular focus being the role of mucus-associated bacteria in inflammatory conditions, says Hazel M. Mitchell of the University of New South Wales, Sydney, Australia, the principle investigator on the study.

"We deliberately chose to examine children newly diagnosed with Crohn's Disease, as we thought this would increase our chances of detecting species that may be involved in initiating Crohn's disease," she says, noting that confounding factors potentially affecting intestinal flora such as antibiotic or anti-inflammatory intake, smoking, or alcohol consumption, are less likely to be present in such children than in adults.

Of particular interest was the finding that one group of bacteria, known as Proteobacteria, was present at higher levels in mild cases, as compared with moderate to severe disease, and controls. That finding, "suggests that this group may play a role in initiation of the disease," says Mitchell, who credits her colleague Nadeem O. Kaakoush with much of the thought and laboratory work behind the study. "The latter finding is consistent with recent studies showing that members of the Proteobacteria, including E. coli and Campylobacter concisus may play a role in initiating Crohn's disease," says Mitchell.

There had been an indication that such was the case, prior to the current study, when the team's earlier research revealed C. concisus to be present in children who already had Crohn's, but not in healthy controls. That information in hand, the researchers grew C. concisus from biopsy specimens from Crohn's children and examined their ability to attach and invade intestinal cells, as compared with strains grown from patients with gastroenteritis, and healthy controls. That research showed that only specific C. concisus strains could invade intestinal cells, that these strains were associated with Crohn's, and that they carried a plasmid which was absent from noninvasive C. concisus strains.

But studies examining dysbiosis (out of balance microbial populations) in adults with Crohn's were inconsistent. That led Mitchell and her colleages to conduct the current study in children with newly diagnosed Crohn's. The results support the theory that Crohn's is linked to a gastrointestinal imbalance in the microbiota, says Mitchell. The bacteria associated with mild disease, including C. concisus, may be initiating infection, she says.
